That said, you and your girlfriend need to find a lawyer that specialises in women's issues/discrimination if the situation really is that serious. Don't ask for free advice from people who probably don't know jack shit about discrimination in the workplace and the legalities involved. Be smart and hire someone who does.

They should be able to give you some viable information about where or whom to talk to. I would also contact the local "Human Rights Campaign"
they had been helpful to me about some discrimination issues I had
although they were quite different from your problems,I think they might be able to advise you. I hope this will turn out okay for the both of you.

As much as some of us know, the only advice that should be listened to from us is get a lawyer's advice. I am not a lawyer so I cannot advise on this. I can speak from common sense and this is a very foul sounding situation.

On the attention, drama, etc.

I have seen numerous people come out here and ask for advice on all kinds of crazy things. If I see one that I think is way to goofy, I will pass it by rather than take the attack approach. It isn't healthy for the forum or the people involved. That said, people need to put the role of LPSG into the proper context.

This is a forum for entertainment and sharing of experiences often related to LP, hence the forum name.

To lafever, often we get in a state of panic and we run to any and all resources for advice. I admire that you can be so open about private life on this scale, but it would terrify me. :smile: Maybe in future if you really have a question like that, you should PM a group of trusted people you interact with on the forum. It often saves you from scrutiny and you seem a pretty nice guy so I don't want you getting harped on all the time.

To Arliss (AKA Brother Truth Speak) and snoozan, you have always been kind, considerate, and welcoming to me and also very sound in your conversations with me. This type of posting kind of goes against what I have come to view from the both of you as I think you are both amazingly smart and truly humorous.

Personal attacks only lead to more of the same and worse. Can we all agree for the moment to put that aside? If for no other reason I am a wee hungover and can't fathom it today. :rolleyes:

Thanks, we`ll definatly check into these things monday morning. We have been given alot of good ideas and some we didn`t think about, it was worth putting up with a few ja****ses.

At first I thought "what, did the boss get her pregnant?"

But seriously, if she is working with chemicals that can harm an unborn child then her decision to keep working is not very pro-life. The boss may know that allowing someone pregnant to work with certain chemicals can cause birth defects and then the company will get sued. You didn't really post enough details for anyone to really understand the situation. Like others said, you should talk to an attorney rather than people on LPSG.

She should not have been fired for being pregnant. Her boss did not have the right to request or demand she have an abortion. Get a lawyer, get a lawyer now! This is discrimination in it's purest form.

That's discrimination and they can't mandate a surgical procedure. You need to get a lawyer and FAST!

If she is working around dangerous chemicals, they can give her leave. If she signed a contract that addresses the pregnancy issue and the company states that should she become she could be terminated/placed on leave or something to that affect, then she may not have a leg to stand on. However, if she can prove they actually said "Get an abortion or get fired", She has a huge case and she should file ASAP.

Thanks new end for the info, as far as her working around chemicals, there are other places at her job they could have placed her, it turns out the boss was also jealous, he`s been wanting to get into her pants for awhile. So this could all be over shani having my child and not his.

Alot of bosses seem to believe because they pay your wage they have 100% control of you, so i can fully understand HOW this could have happened. However im not sure about where you live and the local laws but she should have been offered a different job position away from any harmful chemicals, if she declined that then there should have been a conversation assessing her other choices (eg, resign, maternity leave, redundancy)

But what has happened is HIGHLY illegal .. seek legal advice

You first need to find out her legal status with relation to her job, in the UK there are certain formal procedures to go through before you can fire anyone, but when someone has been working with a company under a certain length of time this impinges on those procedures. I'm sure that in the USA there must be a similar formal procedure and if she's been fired and those procedures weren't followed then that would be illegal and you would have a case.

On reflection, I think I agree with you that what was said was a little harsh-- I was concentrating on the irony of my agreement in sentiment with arliss than with how harshly it was worded. I should have thought more before throwing in with arliss.

I get the feeling we've been told the story in a simplified way as to pull at our emotions and beliefs so that we give lafever the indignant responses that he wants.

However, I could be 100% wrong on that feeling.

I can't see an employer willing to take on the risk of employing a pregnant woman in the presence of chemicals and conditions that may harm a fetus. Depending on the laws in her state, and other conditions as you've stated, this very well may have been completely legal. I also thing that depending on the specific wording of the abortion subject could make it legal. An employer saying, "If you want to continue to work at your position, you can't be pregnant and therefore will have to terminate the pregnancy if you want to keep your job." may be within the bounds of reasonable discourse.

I know in my state the laws are written such that employment is considered "at will," which means that both employees and employers can terminate employment at any time for any or no reason. Depending on the reason, an employer may be required to pay unemployment to the former employee, but that is generally determined by a state agency. This is more to state an example than to make a baseless specualtion, but I know the OP stated that his girlfriend has been having mood swings and severe morning sickness during her pregnancy, and if those things are interfering with her performing her job duties, it may well be legal to terminate her for those reasons.

This is obviously something that needs to be dicussed with an attorney as soon as possible. Because of the FMLA and other laws, this may well be something the employer was not entitled legally to do, but I don't see this as a cut-and-dried case. There are a lot of factors that the OP hasn't made us aware of that could complicate the matter.

With that said, if I were working in a position where I was exposed to possible harmful chemicals, I wouldn't want to continue working while pregnant anyway. It's a crappy spot to be in, but that's something one needs to take into account beforehand, even if the couple doesn't intend to get pregnant.

It sounds nuts to many of us but reading lafever's post I immediately recalled that he lived in Alabama. There are still places in this country that may as well be stuck in the Twilight Zone and there are plenty of them in Alabama. Certainly the entire state is not backasswards. Lots of wonderful decent friendly people down there but Alabama is not a progressive state when it comes to worker rights. Much of the state is afflicted with high poverty and poor education. Unscrupulous employers will take advantage of their employees if they think they can get away with it.

While a support group for those with large penises is probably not the best place to seek legal advice, I think the advice here has been great.

Loss of your job sucks and I'm sorry for your wife. From what you've said about the chemicals she works with, it may actually be a blessing in disguise, possibly saving her life or that of her fetus. If her boss is this unethical about firing her, then I suspect other corners are being cut where worker safety is involved.

I don't know why, I should be used to it by now...some pretty heartless answers from some.

lafever, you and your girlfriend need to find a good lawyer specializing in discrimination cases and have a consultation. These kinds of things are supposed to be against the law, but they happen all of the time. The most important thing is for your girlfriend to not get too stressed and make her pregnancy too stressful...baby comes first. Get a consult and proceed from there, I am no lawyer but I would think you have a case.

Ok, heres what happened, my girlfriends boss told her to get an abortion not once but twice, she didn`t so she got fired friday for making a pro life decision. She was working with dna and rna and we have a list of all the chemicals that are used in the process to their dismay. They seem as though they`re very scared about something.

Anyways, my question is, can she get fired for not having an abortion?

I have never heard of such a situation, and can't imagine any management placing themselves in such a liable position, yet there are always those that do. Reputable companies that work with chemicals are going to be governed by HAZMAT laws and expected to follow them, with inspections thru state officials.

My first question would be, did you girlfriend disregard SOP's, standard operating procedures, and place herself and the child in a dangerous situation? If so, she is responsible and should be fired.

However, if the company has lax SOP's and does not enforce them, or encourages a disregard for them, they are responsible along with your girlfriend.

If she was unknowingly placed in a dangerous situation, get a lawyer. In this type of situation, most will take the case for free.
