Passive consent would involve nonverbal gestures that suggest consenting. And yes, it can be deceptive, so seeking active consent as the norm is what one ought to do.

But if someone is telling you outright that they don't want to, that doesn't allow for interpreting consent in any sense. Not since the 50's at least. Verbal statement of consent or nonconsent ethically (and legally afaik) overrides whatever nonverbal signals one believes one is reading.
