A Danish appeals court has reversed a lower court ruling that would have deported a culturally enriched child-rapist after he served his sentence.

The rapist, a former child-soldier for Al Qaeda in Somalia, raped a 10-year-old girl in Gullestrup, and attempted to rape her 9-year-old friend. After serving a laughable sentence of six years, he will be able to walk the streets of Gullestrup as a free man.

The judge decided on leniency based on the young man’s assertion that he is — get this — “well-integrated” into Danish society.

It would rather depend on whether it is true, wouldnt it? Should someone be punished because he was abducted and forced to be a soldier as a child, or should he be rehabilitated?

He raped, raped, two girls and was attempting to rape another, younger one. Do you not see the problem there?

If it were my daughters, that SOB would be dead the second he walked out of prison. I wouldn't care if I went to jail for the rest of my life for doing it. It would be well worth it! Believe me, he would be MUCH safer in prison than walking the streets.

There are two different issues - the sentence length and the deportation.

It may well be that someone who has lived in Denmark since he was seven, whose mother lives in Denmark, who speaks Danish and has been educated in Denmark, and has no current links with Somalia should be regarded as Danish, whatever his immigration status might be. The language is not that whch UK or US systems are familiar with, but the Danish courts are probably correct that his cultural enrichment is Danish.

However there is another question around the length of his sentence, which does seem very short. Linked are issues around the safety of the community once he is released. Denmark will have processes for dealing with the latter - the reality in Denmark as in the UK and elsewhere is that many convicted pedophiles do walk the streets and are monitored by some form of probation service.

I gather this case is very likely to be appealed to Denmark's supreme court. It seems the original sentence was six years plus deportation - perhaps now without deportation the tariff will be increased. In effect the guy is being offered a choice between further years in a prison in Denmark or his freedom in Somalia.
