The Army awarded the work, under its 2001 contract with KBR. Both the Executive and Legislative Branches object. And the Justice Dept is suing.

It may not be ideal, but I think that it was a reasonable decision. It would be stupid to even consider changing up such a major part of the infistructure with such a short amount of time left. Frankly the charges against KBR don't sound all that serious. It would be like if you have a friend that owes you $20, yeah you're going to want to get that back but you're not going to stop hanging around with them.

This can also, loosely, be related to economics. Say you have a business with a lease on the building up in 6 months. But your business is falling short of breaking even every month. Sometimes it is better to stay open for those 6 months and loose a couple grand each month than to close up shop and loose 20 grand each month. At this point it is better to just stick it out and close up shop when we pull out in 2011.

On the subject itself, I noticed this in the early part of your linked article:

The Army also awarded the work to KBR over objections from members of Congress, who have pushed the Pentagon to seek bids for further logistics contracts.

The Justice Department said the government will join a suit filed by whistleblowers alleging that two freight-forwarding firms gave KBR transportation department employees kickbacks in the form of meals, drinks, sports tickets and golf outings.
It would seem that Congressional efforts are underway to effect changes to existing practices...and the last time I checked, the Justice Department was an arm of the federal executive branch, meaning they ultimately take their marching orders from the White House. So it doesn't appear that the Obama administration is all that happy with the status quo, either.
