The first guy is sitting down, so his penis is measured as longer by as much as a whole inch, you can try it on yourself.
The second guy doesn't seem to be sitting down, but his penis is also clearly angled down and not perpendicular to his body, so he also measures longer, and isn't 9" anyway.

12 and 13 do not exist. It's been established the longest measured dicks on the internet are in the 9" range and an extreme minority 10". Check what has been posted on this thread.
As for sitting down, penis is always slightly shorter than standing up. I have tried this many times myself. You think your dick is bigger if you sit down and use a ruler? I am afraid not, it is the other way round.

I am going to try this out again and see if you are right. Can you really add an inch to your dick by doing this? Every time I have either laid down or sat down my dick is measured shorter than standing up.
I am wondering if anyone has any examples of someone sitting down and standing up, i would like to see the measuring difference.
Bob is correct (at least in my case), Sitting on something low with legs spread out, maybe leaning back and/or pressing down on your shaft does something. It's like your dick sinks down and forward, and creates a gap above it that the ruler sets into. Not sure why, but when you stand up and straighten out it retracts.
