But it does bring up a good point. Someone who smokes cigarettes will have higher healthcare costs than someone who doesn't. How do we balance his freedom to smoke against our having to pay for his care?

Motorcycle riders are not required to wear helmets in many states. Yet states provide funding for traumatic brain injuries. Should we have to pay extra for someone who makes the decision to not wear a helmet?

We could keep going on this. Overweight. Inactive lifestyles. Heavy drinking. Jumping on trampolines. Swimming in shark infested waters. Sliding into second base. Promiscuous unprotected sex.

But if my taxes are going to pay for your health insurance, should I NOT be able to coax my Congress critters to write certain behaviors as too risky into the law?

Now, when the US Supreme Court reviews cases of constitutional law, they use these secondary sources to help interpret the law.

So while the Declaration of Independence not a "legal document" as such, it may have legal ramifications if it reveals something of import to the SCOTUS justices.

Tucker was the first to put seatbelts in cars, if I am remembering things correctly.

For whatever reasons, Tucker's "business model" wasn't viable...but the Detroit's big 3 were, even sans seatbelts.

Said another way, I would rather have some things decided or demanded by the consumer in the free market.

Obviously, car safety standards and healthcare insurance are no longer free markets.

But when the government starts footing the bills for your healthcare with MY taxpayer money, shouldn't I have say via governmental laws and regulations what behaviors will and will NOT be covered?
