    I'm not sure where this distrubing CNN Newsroom item should go, so I have placed it under the forum (as a form of discrimination)
    In brief, CNN has reported a young black woman (20-21 yrs old) living in So. West Virginia (Logan) was kidnapped, sexually assulted (raped), suffering from unbelievible torture at the hands of 6 white individuals (both males and female who are related as mother and sons).
    This went on for one week before this victim was discovered alive.
    She had been kicked, beaten, hair pulled out from her scalp, stab wounds in her legs and stomach and more ... She hospitalized and was shown.

    She was forced to eat dog food, drink water and waste from the toliet and made to perform (what was decribed as some of the most horrific, prevert acts that this law enforcement had ever heard of in the history in this southern town.
    Now here's what gets to me .... the charges that the law enforcement is trying to formost get these 6 people on, is that of a "Hate-Crime" because of the racial "expletives" and names they used and called her while they raped and made her perform sexual acts.

    WTF= am I missing something here:confused::mad:

    I sure in the hell hope that these investigation charges go deeper than this!
    This young black woman was almost found in worst condition than they use to do the plantation black slaves (men & women); and this is what...2007:confused:
    I'd also like to point out, for those of U who think things like this, don't still go on in the south...think again!
    USA racialism, hate crimes against black men & women, and KKK elements are very well and alive here down south daily...some cases more serious than others that gets media attention, as this one. But many don't!
    And yet, our government takes on the issues, spending billons of dollars, and army forces to fight over in Iran & Iraq for their freedoms and human rights and trying to form their govenment business.:confused:

    I JUST DON'T GET IT!
    It DISTRUBS AND WORRIES ME (when it happens to any person no matter the race or color, male or female, whatever sexual orientation or life style an individual may chose) to be treated this way.
    Where laws when we need it to apply for crimes of this nature:confused:
    OK enough.
    I welcome some of your comments about this case and trend if clear to where I'm coming from. A crime case to be followed for outcome...

    ...
    The six are charged with kidnapping, sexual assault, malicious wounding and battery. Kidnapping is punishable by up to life in prison.

    But now today I've heard that the Feds won't pursue this as a hate crime and is leaving it to the state. There must be more to this than meets the eye cause it sure sounds like a hate crime to me...very disgusting.

    The assailants (two of whom were women) all had criminal records.

    There's something to be said for throwing away the key when people are locked up for violent crimes. Society would be a lot better off.

    The reason I heard for dropping the hate crime charges, was that it limited to time available for jail, and that the state charges without the hate crime part would lead to life in prison.

    I was watching MSNBC yesterday morning, "Morning Joe"... and the reader just flatly refused to report the crime, just giving barest details. She said it just disgusted her too much to go into it too much. I thought that was smart. We don't need all the bloody details on all the perverted crap that goes on.

    Who knows. We have a situation in a town up here where a little girl is fighting for her life because some (pick your own expletive) shot her in the face.

    Ditto Invisbleman. No one should ever have to endure such torture.

    Thank goodness that the Prosecutors are thinking. Hate Crimes charges usually do get watered down when you get into situations like these. hate crimes was more for racial epithets, property damage, bodily harm that falls short the typical legally charged ones (spitting, slapping, punching, etc.). In this poor woman's case, she has more than enough to put these idiots away for the rest of their natural lives.

    The entire concept of hate-crime legislation is stupidity codified. Acts of atrocity are illegal, regardless of the perpetrators' motivations. Attempting to subdivide statutes based on ephemeral, non-quantifiable criteria like state of mind adds absolutely no value to the carriage of justice.

    Yes, this incident is deplorable in just about every aspect conceivable, but it serves no constructive purpose to prosecute the case differently because the word nigger was used. Propagating distinctions among people based on race, gender, orientation, or whatever in the laws will only serve to fuel the irrational hatreds that already exist against those groups in society.

    Does the Twinkie Defense ring any bells? Dan White served five years of a seven and one-half year sentence for killing two people. The jury found his actions were partially justified because Harvey Milk's existence depressed him to the point where he was no longer in control of his actions.

    Disgusting.

    Kill some people after having a dubious "capacity diminishing" reaction to eating Twinkies and it becomes a mitigating factor in a trial that gets your charge / sentence reduced.

    Kill someone behind the wheel of a car after having a clinically proven capacity diminishing reaction to alcohol and you're told that you should have known better and have the book thrown at you.

    Makes perfect sense. :rolleyes:

    What I don't get is, what the fuck is a hate crime?

    Seriously, if I murder one of you for sleeping with my girlfriend, isn't that a hate crime? Because I hate both of you so much I murder you?

    It'd be simple GBH, attempted murder and kidnapping here.

    well hate crime is something they made up to feel good about themselves
    what difference does it make WHY I commit a crime
    a crime is a crime right?
    if you can add in reasoning for breaking the law to say it is worse you MUST be able to add in reasoning for breaking the law to make it go easier on you
    so if you have hate crimes you must also have legalized vigilantism...

    Motive is always a factor in everything from the prosecutor deciding which charge to press to "extenuating circumstances" offered by the defense to sentencing.

    You really never have heard of Dan White, Harvey Milk and the Twinkie Defense, have you?

    A man assassinated the mayor of San Francisco and a City Supervisor in City Hall and served about six years because the jury was more sympathetic to the killer than his victims. This happened in 1979 when I was 19. In other words, in recent memory.

    Vandalism is generally a minor offense. An anti-semite who desecrates a Jewish cemetery with Nazi symbols and slogans causes incredible pain to a community at large, not just the families of those buried there. This goes way beyond spraying a tag on the wall of an abandoned building.

    The fact that you can't understand that these examples warrant sterner measures speaks volumes about your empathy.

    Hazelgod, do you actually believe this? Have you ever known someone who was targeted because of their racial, sexual, religious, and or gender identity? Are you really of the position that there would be less crime against protected groups, if they were not afforded protection. Are you also going to argue then, that there was less crime against Black, Jews, Gays, Disabled, Transgendered people prior to the passage of Hate Crime Laws.

    Please be careful, not to fall in line with arguments propounded by New Racist/Sexist/ Thinkers, which see the codification of legal protections for Historically harmed groups as SPECIAL TREATMENT.

    Things like this are why we should have flat, blanket sentences. None of this bargaining or negotiating nonsense. In one state, a guy can get 15 years for raping a 6-yr-old, but in another, he serves 3 months? Wtf is that? That's asinine and does nothing to help or protect society, and that goes for so many types of cases.
