It's called the "Commerce Clause"....google it.
The commerce clause was never meant to be a catch all. That is an absurd position. Its not like you can't look up what the people who drafted that clause thought. Not to mention, the 10th amendment would reserve healthcare to the states; but hey you only cite the pieces of the constitution that make people live like you think they should live; liberals call it "tolerance".

BTW, right now Prop C is passing with a 75% majority. Thats a stronger margin than the gay marriage amendment.

We'll see how it pans out, but this is the death knell of Obamacare. Mark my words.

You're right, there is no history in the Constitution, nobody ever wrote down why they added, or deleted clauses. It was all just thrown together on a whim by a bunch of drunk jerks.

I can't watch TV tonight because I read your sentence.......that would be too much mind numbing for one evening.

Precisely. Even the people who signed the Constitution disagreed on what various parts meant. Contrary to conservative opinion, there was no such thing as a monolithic opinion among the Founding Fathers.

I think individuals who "opt out" should have to be registered........so that IF something disastrous happens to them (of course very unexpectedly -- as are most disasters) -- there is absolutely no chance for them to opt BACK into the system (once they see just how valuable having insurance is!!) Once again --- it's just a mindset of "I have -- you don't..................tough crap!"

If Missouri doesn't want to participate, so be it. Conservatives say this is going to end up costing the tax payers a bunch of money, so let Missourians subsidize everyone else through their federal tax dollars. It's about time they got off the government teat and started paying their fair share.

You're failing to convince us why the vote in Missouri is indicative of what Congress is going to do. Thank goodness we don't have a national referendum apparatus in place. Missouri can bitch and moan all it wants, it isnt going to change the fact that the law is unenforceable.

It's amazing how brutal mean liberals get when you start telling them you don't want their "fix". I've been saying all along that liberals don't care if people live or die (see post above) this is about a socialist president trying to pass as much socialism as he can before he loses re-election; and the liberals want on the bandwagon so they can say, "You get _______ benefit, and I brought it to you. Helped you right out of your own shit. *pats own back*"

Oh good lord. The people of Missouri can't just pass an unconstitutional law. If the Health Care reform bill is declared constitutional by federal courts, they better drink their juice. I'm all for democracy- as long as it conforms to the Constitution. If Missouri would like to opt out of the system, then I'd like them to voluntarily give up any federal dollars they receive in excess of what is sent to DC.

Correction: you're all for democracy as long as 1) it conforms to your interpretation of the Constitution, and 2) you like the result.

Imagine if there had been a referendum on the Iraq war: "Prop A: you can't send Missouri boys to die in Iraq." You would have creamed over that. It would have been the triumph of the people. Instead, the people are saying, "hey, socialist, we want our liberties back."

Regardless, in a country that has a tradition of representative democracy we are supposed to be "represented" at the federal level. We aren't. They are passing whatever they want so they can give MASSIVE kickbacks to their healthcare buddies. Missouri isn't standing for it.
