Burden of Proof


In most discussions of the burden of proof, the burden lies with the plaintiff. The respondent does not have to defend against anything if the case is not sufficient.​

There is an exception however, where the burden of proof is reversed. In a Quo Warranto case the plaintiff challenges the right of the respondent to hold office and the burden of proof rests on the office holder.

In the United States today, quo warranto usually arises in a civil case as a plaintiff's claim (and thus a "cause of action" instead of a writ) that some governmental or corporate official was not validly elected to that office or is wrongfully exercising powers beyond (or ultra vires) those authorized by statute or by the corporation's charter.

"Only in America can you make that much money crying," Graham said of Beck. "Glenn Beck is not aligned with any party. He is aligned with cynicism and there has always been a market for cynics. But we became a great nation not because we are a nation of cynics. We became a great nation because we are a nation of believers."

Appearing before a crowd of Washington's elite power players and opinion-makers, Graham spoke largely without filter, offering acidic takes on subject well beyond Beck. The Senator called the birther community that questions the president's U.S. citizenship "crazy" and implored them to "knock this crap off" so the country could get on to more important matters.

"I'm here to tell you that those who think the president was not born in Hawaii are crazy," said Graham, who went on to dispel another myth: that Obama is a closet Muslim.

Just "knock this crap off" huh...interesting that's exactly what Sen. Graham should say to President Obama. Mr. Obama could easily and quickly clear things up. If Mr. Obama was indeed born in Hawaii as Sen Graham states, in one of the hospitals Mr. Obama throws out when ever the mood hit him and Dr. West delivered him and Dr. West's name is on his long form birth certificate then Sen. Graham should be pressing the President to demonstrate the transparency he claimed and release the documents and put the matter to rest.

Sure. Why is there name calling and requests to end inquiry into Obama's eligibility when President Obama can easily and quickly put the matter to rest? If Mr. Obama chooses not to do that, they need to quit cry babying about voters requesting the vetting that Judge Land justified.

Sen. Graham should be imploring Mr. Obama to clear the matter up with what he promised: transparency. If Sen. Graham is sure Mr. Obama is born in Hawaii then there should be no problem with releasing a long form birth certificate.

Sen. Graham should be imploring Trinity to clear the matter up with what he acknowledged: trolling. If Sen. Graham is sure Trinity is born under a bridge then there should be no problem with releasing a long form birth certificate.

He's right about that too. There are too many news outlets and too many lazy people willing to be lead unthinkingly str8 into their own comfort zones of prejudice and fear, by charlatans like Beck and O'Reilly.

Maybe someone in the Republican leadership is finally 'getting it', that letting these fringe nutjobs and Glenn Beck & Co set the conservative agenda, is a sure fire losing strategy.

Not the 24 hr news cycle. Obama's policies are wrong. It's not the people talking about Obama's policies...it's Obama's policies.

Sen. Graham needs to be pressing Obama to be transparent and clear the matter up by releasing his documents including his long form certificate of live birth.

Eligible or not, Obama has been a disaster who hasn't accomplished a damn thing yet.

- Czars falling by wayside due to incomplete or incompetent vetting
- Country more divided than ever along ideological lines
- Healthcare Reform about to go bust
- Unemployment approaching nearly 15% in major cities, 10% country wide.
- Recession deepening
- Debt growing by leaps and bounds
- Losing the battle in Afghanistan - the media is quick to report soldier death numbers during Bush's terms, but look at those numbers now - just sad, and rapidly increasing.
- "No more taxes if you make less than $250K/yr" - let's see if he stands by that.
- Transparency? What transparency?
- Taking "a couple of weeks" to evaluate Afghanistan when he hasn't listened to his military commanders on the ground in 100 days or more? This equals more US soldiers dead.
- Wavering position on Iran, even has the French! The French, telling him to "man up."

I know there is a long list for Bush as well, but really, what has he "CHANGED" since he has been in office? Big Fat Zero.

So, eligible or not, he is quickly proving to be the president that gets NOTHING done.

Edit: Here's the numbers. 2007 US casualties, 117. 2008 US casualties, 155. 2009 US casualties, 223. So is the enemy getting stronger or have we gotten weaker? Yeah, you guessed it, since BO has been in charge, our casualty rate is GROWING, and he won't even listen to commanders about what needs to be done. Remember mocking Bush's Iraq surge? Well, it WORKED.

I liked the GI bill he signed for the military, that lets soldiers pass on the money to their kids,

I don't agree that the country is more divided than ever, you just have people being more vocal about it.

I think you may have a point there. I think people are just more "irritable" on across the spectrum, because, at least at this point, I don't think either the "conservatives" or the "liberals" are happy with what is going on.
