Proposition 8 is overturned as unconstitutional by judge walker !!!!

    :biggrin1: FINALLY !! the good judge, Vaughn Walker of the Federal appeals court, has overturned one of the most vicious, nasty ballot initiatives OF ALL TIME. It will take months to get this through the 9th district court of appeals and years to the supreme court.
    Thank obama and God thank Elena Kagan will soon join the high court.
    This is a great day to be gay in California. God bless judge Walker and all of those of you who have worked so hard with me to overturn this travesty.

    Yeah, it's a very cool turn of events. I only hope the other courts will be as progressive, and humanitarian, on this subject, as is Judge Walker's.

    Probably the most significant thing about this is that this is the first time a Federal judge has weighed in on the constitutionality of the same-sex marriage issue. Lots of fights to come, but this is a significant and positive milestone for *all* Americans.

    I really liked Rachel Maddow's comment that whenever Americans get to vote on minority rights, they vote no, but this is a CONSTITUTIONAL democracy and RIGHTS are not subject to elections. Look forward to her commentary tonight.

    Fabulous (if not entirely unexpected) news!

    Not to nitpick with the OP, but Ms Kagan has never actually come out publicly as regards her views on marriage equality. If she had, her appointment would most assuredly be blocked by the GOP, whose platform (last I checked) STILL includes a plank favoring a constitutional ban on same-sex marriage on a federal level.

    This is tremendously important and will surely have ramifications far beyond California.

    Which is why it is at times proper recourse for government and the courts to judiciously weigh in on such matters.

    Perhaps not surprisingly, Andrew Sullivan's Daily Dish is the best place I've seen yet for decisive and extensive coverage of this ruling. Check it out.

    He and his partner Aaron were married in Massachusetts a few years back, and has been a fierce proponent of marriage equality (despite his otherwise conservative take on most issues) for 21 years.

    Step one complete. Next stop 9th District court. And then FINALLY the Supreme Court where we will be heard once and for all. This is a good day not only for all gay Americans but any American who has been on the front lines fighting for equal rights for all.

    I was driving when I heard the news and I swear I almost wrecked from all the bouncing up and down, screaming and yelling in unparallelled joy, and fighting back the tears of victory. I am so proud to be an American today.

    This victory creates a real dilemma for the "other side." Up to now, if they lost in California things returned to where they were before prop 8 passed. Now, if they appeal, they risk losing on a regional or national level. Let them fucking squirm! I love it.

    I have a bad feeling that they will seriously consider not appealing. I find it hard to believe that the present SCOTUS (with either Kagan or Stevens ) will find any significant fault with the legal reasonings in today's decision.

    The anti-gay marriage bunch have to tread carefully here. The last thing they will want is to have their actions be responsible for the legalization of gay marriage in the RED STATES

    Correct! However, I think they will appeal because they are blinded by thier ideology. Like Glenn Beck, they should pull their heads out of their asses and their vision would be 20/20.
