Who does that? I think I would notice if the top took off the condom. If I found out afterward that he did it, I would be outraged. I would consider legal action, certainly.

Sure. There could be criminal charges. Charges of sexual assault for sure (if consent included use of a condom, it could be bumped up to rape). Conspiracy to commit sexual assault. If they had an STD, they have a legal obligation in many places to inform you, and get your consent to proceed without protection.
In civil court, you could sue for any damages resulting from the encounter. Specifically including costs and damages related to being infected with a disease.

Yes it is possible and yes it happens. When I'm in groups or at sex clubs I'm always certain to get fucked on my back or in a sling so I can keep and eye on the top. You can't really tell if they remove the condom.

I've had it happen to me as well... and nearly kicked the guy across the room in the process. Don't trust anyone! Especially if your judgement is impaired. Guys will say anything to get what they want. As the t-shirt says: "Boys Lie!" The top will obviously feel the difference, tho I doubt most bottoms will.
I've only bb twice and it was with people I trusted to be clean (and they were). I can attest that I could certainly feel the difference between bare and protected. Bare requires far less lube, and the lack of texture from the condom led to less sensation for me. I won't be doing bb again, but I seriously doubt anyone could miss the difference in sensation...
