I think it's the most logical explanation because otherwise those scenes would still be up.

I'm not entirely sure.
Even if some files got misplaced, it is reasonable to assume that they did give their consent at that time, and if no one has challenged that (i.e. demanded that the videos will be taken down or claim that he did not give his consent) deleting said videos will only lose them money.
