Federal judge allows emoluments case against Trump to proceed

A federal judge on Wednesday rejected President Trump’s latest effort to stop a lawsuit that alleges Trump is violating the Constitution by continuing to do business with foreign governments.

The ruling, from U.S. District Judge Peter J. Messitte in Greenbelt, Md., will allow the plaintiffs — the attorneys general of Maryland and the District of Columbia — to proceed with their case, which says Trump has violated little-used anti-corruption clauses in the Constitution known as the emoluments clauses.

This ruling appeared to mark the first time a federal judge had interpreted those Constitutional provisions and applied their restrictions to a sitting president.


If the ruling stands, it could bring unprecedented scrutiny onto Trump’s businesses — which have sought to keep their transactions with foreign states private, even as their owner sits in the Oval Office.

Messitte’s 52-page opinion said that, in the modern context, the Constitution’s ban on “emoluments” could apply to Trump — that it could cover any business transactions with foreign governments where Trump derived a “profit, gain or advantage.”

“This includes profits from private transactions, even those involving services given at fair market value,” Messitte wrote.

Trump Organization subpoenaed for business records

washington (CNN)Subpoenas have been served on the Trump Organization and a dozen linked entities in a lawsuit challenging President Donald Trump's ongoing business ties while in office.
The office of District of Columbia Attorney General Karl Racine said Wednesday that it "can confirm that all of the Trump Organization entities have been served." Additionally, subpoenas are being served to the state of Maine, the attorney general's office said.
The lawsuit by DC and Maryland claims Trump is in violation of the Constitution's ban on emoluments, or payments, from foreign or domestic government entities to the President because of his continued interest in the Trump International Hotel.
DC and Maryland have said the Trump International Hotel's operations put other nearby hotels and entertainment properties at a competitive disadvantage, and that the Trump hotel got special tax concessions. The hotel won its lease on federally owned property before Trump's election.
A federal judge set in motion the schedule for DC and Maryland attorneys general to begin collecting evidence in the case. The plaintiffs say they also plan to subpoena 18 entities that compete with the Trump Hotel.

Trump could avoid all this without having to sell off all his properties if he wanted to.

Trouble is he just does not want to.

The whole run for president was a marketing campaign anyway for his brand. Who knew even he didn't that hate could sell so well.
