Well this will certainly signal to any undecided Reps. which way the wind is blowing. I also read an article about LG saying that they need Trump to win the midterms. No justice, no constitution, no checks and balances just politics. If a sitting president can't be charged and this is not a convictable offence, can the USA officially announce that the president is now officially above the law?

Oh! I suspect Republicans understand. Getting some Republicans to admit this publicly is another matter!

Moscow Mitch admitted that Trump is guilty and that criminal charges can be filed against Trump.

But Mitch claims that the constitution only allows for the impeachment by the House and conviction by the Senate can only be done while a person is holding federal office.

Mitch's point is that since Trump is now a private citizen, the constitution does not allow for a conviction of impeachable offenses once a person is a private citizen.

McConnell is a slimeball. He got a big burr up his butt in 1987-8 over the Senate's rejection of Robert Bork's SCOTUS nomination and has been hellbent on revenge since. Someone needs to pull it out of him after 34 years. Any volunteers? ;)

Such was the blindness of Reagan by nominating the man (Bork) who carried out Nixon's Saturday Night Massacre effectively colluding with Nixon's obstruction of justice during the Watergate investigation.

So odd when Reagan had many other qualified conservative judges from which to choose. It's almost like he nominated Bork intentionally.

There's still time to impeach and try George W. Bush for his crime of starting the Iraq War based on false pretenses and oh the multiple and massive war crimes which followed.

The Senate voted 57-43 to convict Trump. It requires a 2/3 majority to convict or 67 out of the 100 senators. Seven Republicans voted to convict Trump. This was the most bipartisan vote for conviction for presidential trials in the history of the republic.

McConnell is right now speaking and has said that Trump is guilty of inciting the insurrection at the Capitol, but that the Constitution only allows for Impeachment and Conviction only for people who presently hold office and that the constitution does not allow for the impeachment of private citizens.

He has a point. Mitch did sway my view just a little. Mitch may be correct that the House may not impeach a private citizen.

However, if the House impeaches an office holder, the Senate shall conduct a trial even if the person resigns or the person's term ends and the person is now a private citizen.

The Senate should conduct a trial of Trump because the House impeached Trump while Trump was still in office.

I would add that while the Constitution does not cover this, the trial should be done in a timely matter or as soon as reasonably possible after the impeachment passes the House of Representatives.

I suspect the Framers would have not meant for a person to be impeached by the House and the Senate piss off having a trial for weeks, months years.

With the election of new people and their taking the trial was held as soon as it was reasonably able to do.

I will add that if a president or other federal office holder were to commit impeachable offenses the last day before their term ends or the person resigns, an impeachment would be constitutional provided it was done as fast as the House can reasonably meet and take action.

Christmas vacation, the ending of terms in January of even years, etc. do provide a window where a few days do to this, make a few days wait for the House to meet to consider impeachment reasonable.

Courts have ruled that terms like reasonable, etc. are applicable to interpretation of the Constitution.

In short:

If the House impeaches someone, the Senate shall hold a trial within a reasonable time even if that person's term ends or the person resigns his office.

If an office holder commits an impeachable offense and resigns or has his term end, just hours or a few days at the most, then the House can still impeach that person and the Senate shall hold a trial.

The Constitution does not allow for impeachment for people who are private citizens and have been private citizens for a while.

And, never does the House have the constitutional power to impeach a private citizen for acts committed while a private citizen.

Having written this, the Senate has set a precedent. The Senate is now honor bound to follow this precedent in the future when it is a Democrat who has been impeached and is now a private citizen.

Problem being, Freddie, that NONE of the above will matter as far as the GOP is concerned because what they apply defend or oppose in one case they'll CHANGE FOR THE NEXT. They've PROVEN that, time and time again. That's PRECISELY what makes them a bunch of hypocritical mfkrs.

In the end, the darkest truth of Donald Trump’s crime came to light.

As his marauders sacked the Capitol on Jan. 6 in their bloody attempt to overturn the election, House Republican leader Kevin McCarthy called the then-president and pleaded for Trump to call off the attack.

Trump refused, essentially telling McCarthy he got what he deserved. Trump was, in effect, content to let members of Congress die.

That damning account, in a statement* Friday night from Rep. Jaime Herrera Beutler (Wash.), a Republican who defended Trump during his first impeachment, momentarily threw the Senate’s impeachment trial into chaos on its final day.

Trump’s lawyers, in their slashing, largely fictitious defense, claimed that Trump was “horrified” by the violence, hadn’t known that Vice President Mike Pence was in danger and took “immediate steps” to counter the rioting.

But Herrera Beutler revealed such claims to be a lie. When McCarthy “finally reached the president on January 6 and asked him to publicly and forcefully call off the riot, the president initially repeated the falsehood that it was Antifa that had breached the Capitol,” she wrote. McCarthy, she continued, “refuted that and told the president that these were Trump supporters. That’s when, according to McCarthy, the president said: ‘Well, Kevin, I guess these people are more upset about the election than you are.’

People complaining about the witnesses in the trial make no sense and are simply ignoring reality still. The Dems completely proved the case. The senators in the chamber WERE witnesses. As were all their aids and families, and all the police officers who were injured and died protecting them on January 6th. Mitch McConnel flat out told the entire world in that speech that the Democrats were right, they made their case. Trump was the cause, he incited it, he sent the mob there to attack them and he didn't do a damn thing to call them off. He didn't convict because he is a pussy and wants to have it both ways. He is the reason the trial wasn't held while Trump was still in office. But, pretends his hands were tied on a made up technicality that was already voted on earlier in the week. The Senate voted on the question and yes they can have the trial and convict after the President was out of office. He choose to ignore that vote because he wanted too. He thinks he can keep the trump base to get power back. And still get rid of trump by admitting yes he did it and the Criminal justice system should take him off his hands and "get him".

The House managers explained again afterwards in great detail. They could have called GOD to the stand, as Manager Swalwell said. It wouldn't have made any difference the GOP wanted to let trump off and there was NO way they were getting 67 votes.

The trial still had to happen. The Democrats did exactly what they had to do. Trump's actions were so egregious if that wasn't impeachment worthy then nothing was. They laid out an easy to follow case to the American public, a lot of whom only watch certain outlets. Even Fox news and the more right wing crackpot networks carried most of the case live. So more people were exposed to the body cam footage, the visceral proof that yes this was an insurrection despite right wing media downplaying the violent, murderous intent of this mob of clear Trump supporters. Even some Senators had no idea how close they were to the mob until they saw that unreleased security footage. Romney didn't know he was that close and it was Officer Goodman that had him turn around and head for safety. Many people including me didn't realize how close these insurrectionists were to actually getting lawmakers despite watching the chaos live as it aired January 6th. The House manager presentation with aids huddled under desks whispering calling for help behind locked doors while crazed Trumpers bashed the barricaded doors and "hunted" them. Needed to be shown in this way.

Trump didn't have a defense. The fact that those bumbling, ambulance chaser lawyers he had kept having to get assistance from the GOP senators like Cruz, and Lindsey showed the world all trump needed was warm bodies. GOP was going to acquit him because they need his base and need the money. Senator Tuberville flat out admitted multiple times he spoke to trump and told him Pence was evacuated that day. He knows trump didn't give a shit. Yet he voted to acquit. They all knew the truth. They didn't care. No witness was going to make them care.

ALL of those willing to testify.

Just to put a human face on all the pain and suffering and turmoil Trump and those fkrs caused. However long the testimony would've taken.

Trump's co-conspirators in the Senate would've done just the same. But the testimony of those witnesses would've played out before the American public and the WORLD,

in REAL time, etched into history FOREVERMORE.

The GOP would have gotten an equal useless witness to waste time. They don't care if Biden's agenda gets passed. Would Trump have been mad sure who cares if he is mad what would it have gained? Saying the changed their "strategy" after that.

They don't care if people die and suffer because of lack of resources from Covid relief. They will just blame Democrats for holding a trial that lasted months and got no conviction and run on that in midterms which are already perilous for Democrats.

The one thing I agree with Mitch is those families should sue the living shit out of Trump. I don't know if they can win but the standards of civil suits are much lower if not for trump their loved ones wouldn't be dead, or maimed missing eyes and fingers etc. They wouldn't be so traumatized they committed suicide after.

The very fact that McConnell refused to allow an impeachment trial before 20 January shows he was in cahoots with trump if he truly believes what he stated as his reason for acquittal.
However the deed has now been done, the damage unknown and trump once again crowing about a witch hunt - pity he cant be dunked in water to prove he isn't a witch!
The GOP now have to decide if they are going to regroup, abandon Trumpism and go a truly Republican way or are they going to stick with TRUMPS GOP.
Some members of the GOP say they have to look to keep their seats in the mid term elections, then maybe they'll dump the chump. But by then it will be more elections in 2 years and so the cycle continues as Don jnr, Ivanka and silly Eric all rush to become head of state backed by radical right wing racists who don't necessarily believe in Trumpism but love the violence and racism - and who admitted they didn't believe trumps lies about a rigged vote and a stolen election.
Regrettably the GOP do not believe they are strong enough to withstand a trump family onslaught, they truly should believe that it's worth the pain to gain.
Senator Collins this time had the grace to vote according to the evidence, one of 7 Republicans. The rest will once again state trump has learned a lesson to try and salve their consciences, its easier to give in, cave before a wall of bluster than fight for the right, once again politicians have proved beyond a shadow of a doubt they are not fit to stand for office, not fit to be in office if they don't represent what is right.
History will record that on trumps which thousand died during the pandemic, millions became infected and he did nothing.
History will also record that he was twice impeached and found not guilty, the votes in his favour from those with vested interests.
History will also add another footnote on the second impeachment - the insurrection he was responsible for caused millions of dollars in damage, cost millions in defence, caused in humble state servants to flee for their lives, state officials in fear of death and the Vice President hustled out of a back door (and it took the president 5 days to enquire if his VP was well) as the baying mob screamed "hang Pence". Worse were the 140 law enforcement officers injured and the five deaths.
The history books will have plenty to record as this president has the most shameful record ever recorded, from racist closing of borders to certain religious groups to the separation of children from families - split and parted without documentation down to his attitude to women regarded by him as sexual objects. Finally, and this won't be missed, was his collusion with criminals and crooks, bent lawyers all there to make sure nothing got in the way to keep him in power, his associates make the Mafia look like kindergarten, and yes, it wasn't about America, it wasn't about the people it was about trump and POWER.

Has little to do with "vengeance" and much to do with the people bearing witness to the truth, WHOLE truth and nothing BUT. Anytime their fkn lawyer can stand there and claim it was "antifa" storming the Capitol, America can CERTAINLY afford to hear otherwise.

There was GOOD reason why the prospect of witnesses horrified Trump's lawyers. And it had NOTHING to do with attending to the people's business. So I guess we'll just have to DISAGREE.

If we are truly now in cancel culture, maybe the Democratic parties of the 43 Senators should find reason to immediately draft paperwork to repeal each of those Senators themselves for their lack of following constitution. Don't just leave the apolitical investigations to nail Trump- hold these accomplices liable as well. Justice matters, and this "process decision" was a total sham. Our Union took THREE huge hits in the space of one year- First the first acquittal, then an insurrection against our government and officials, and now a second acquittal. All with clear evidence, on camera, recorded, and in public. We are NOT a foreign government- this is the United States of America.
