The Republican-controlled Senate on Wednesday afternoon confirmed Lawrence VanDyke to the Ninth Circuit Court of Appeals, marking President Trump's 50th successful appellate court appointment in just three years in office, and his second to the historically liberal Ninth Circuit in as many days.

By contrast, President Barack Obama nominated a total of 55 circuit judges who were confirmed over eight years -- and Obama's nominees were, on average, approximately ten years older. The White House has dramatically transformed the Ninth Circuit, a powerful court with jurisdiction over nine states that has long been a thorn in the president's side.


Of the 30 active seats on the Ninth Circuit, 10 have now been appointed by Trump, and 14 by Republican presidents. Only nine of the court's 19 semi-retired "senior status" judges were appointed by Democrats, with 10 by Republicans. That's a major change from early last year, when only six of the active judges on the Ninth Circuit were chosen by Republicans.


VanDyke's confirmation, by a 51-44 vote, came just 24 hours after Patrick Bumatay, an openly gay Filipino man, was also seated on the San Francisco-based Ninth Circuit. Both nominees were fiercely opposed by Democrats, including the senators from their home states -- Nevada Sens. Jacky Rosen and Catherine Cortez Masto for VanDyke, and California Sens. Dianne Feinstein and Kamala Harris for Bumatay.

Big congratulations to Patrick Bumatay! Years ago, would not believe that an openly gay man would be appointment by a conservative president

I hate to link Fox News because it is a rag, but someone else posted it in a group chat of mine and I was proud to see Bumatay earning his spot.

"The Senate confirmed Lawrence VanDyke to a lifetime appointment on the 9th U.S. Circuit Court of Appeals on Wednesday by a vote of 51–44.

Every Republican present except Sen. Susan Collins voted for the nomination; every Democrat present opposed it.

Like Sarah Pitlyk, a judicial nominee confirmed just last week, VanDyke received a rare “Not Qualified” rating from the American Bar Association. After conducting 60 interviews, the ABA found that VanDyke has a reputation as “arrogant, lazy, an ideologue, and lacking in knowledge of the day-to-day practice including procedural rules.”
Video of VanDyke lecturing, scolding, and interrupting judges during oral argument while serving as Nevada solicitor general lends credence to that assessment.

VanDyke has a long record as an anti-LGBTQ activist.

He wrote in 2004 that marriage equality “will hurt families, and consequentially children and society.”

As the solicitor general of Montana, he advocated for the state to join two briefs alleging that legal recognition of same-sex relationships would harm children. The first claimed that prohibiting same-sex marriage promoted “optimal childrearing” because same-sex couples “cannot provide” the optimal “family structure.”

And the second asserted that states “may rationally conclude” that “it is better” for parents to have a “biological” connection to their children. (The Supreme Court disagreed, ruling that a same-sex marriage ban “humiliates” the children of gay couples.)

In 2010, VanDyke also filed a brief urging the Supreme Court to rule that student groups at public universities have a First Amendment right to discriminate against LGBTQ students.

Can you at least try and be happy for Bumatay. What a monumental moment for our representative republic

If he is approved by Trump and the Federalist Society is another stain on the republic, not a monument to anything but stupidity and hatred.

And for the record, Clinton and Obama both appointed openly gay judges. In fact Obama nominated ELEVEN openly gay judges, MOST of whom were STALLED in the Republican controlled SENATE.

NOT to mention what the GOP has written in THEIR party platform regarding same sex marriages.

So let's not try to play games and blow smoke up our asses here as to who has and has NOT been the most supportive of the LGBTQ community.

Never said Bumatay's appointment was a bad thing.

I'm saying that YOU are attempting to USE IT as a means to deflect from all the other anti-LGBTQ appointments, platforms, and policies enacted, supported, and ENABLED by Trump, the GOP and their shills, supporters, defenders, and sycophants (not naming names, though).

And yes, racism is involved too, because it's a part of their whole, twisted, sick-fuck, mean spirited IDEOLOGY.
