Early this year, an attractive Asian guy moved into an apartment across the courtyard. His apartment windows are about 50 feet away from, and one story lower than mine. I have a direct view of his bedroom.

Until the weather turned nice, his curtains were usually drawn, but occasionally I would catch glimpses of him walking around. This evening, his bedroom curtain was wide open and I had view of his shirtless torso -- lean,with a nice v-shape, but I did not get a front view.

Cutting to the chase, at what point what point does catching glimpses cross the line into being a Peeping Tom?

I consider a Peeping Tom is someone who goes out of his way to look in someone's window, especially when the other person would have no reasonable expectation of being seen. For instance, to creep up and peek through a gap in someone's curtains. Or, as in the old joke, climb up on top of your dresser with binoculars.

In your case, this fellow should have every expectation that someone could look in. You should feel no compunction about looking as much as you like. With or without binoculars.

When I was in my early 20s, I was visiting a gay couple I knew. All of a sudden, one of them called out from the bedroom, "He's at it!" Too bad my situation has not been, and will not be ongoing. I am moving into a new Condo; in 14 days I will be out of the one with a good view. :) I must admit, the old place had a view that never amounted to anything until the endrt, and one that I will never have again.
