What Is “public Nudity?”

I didn’t want to get philosophical on a long running pic thread (it’s in the underwear Subforum), but the discussion had turned to “what’s public?”
Many of the shots are porn. Closed sets, staged, whatever. And folks brought it up.
Sort of like the line if a tree falls in a forest logic.

so, is public a location, or is it being, or potentially being, seen?

my take as of now:

I often peel off layers during a hike, usually to wet them in a stream.
The land is public.
I do not want to be seen. I am not an exhibitionist. And I don’t want to be a voyeur.
I choose trails based on low density, and go back where my privacy is almost assured.
When hiking with an intimate partner, there’s the option of some nakedness, but not “nekkidness.”

Nudity is not pornography. The person has to touch their genitals in a sexual manner for your "shots" to be classed as porn. Public nudity is indeed nudity on public grounds. All public nudity statutes should be abolished IMO. Ideally a filmmaker would obtain a permit to film in an area that was normally accessible to the public. A closed set would be a standard practice to stop both another person from filming his activities and to eliminate the prying eyes of outsiders/ the general public.

Please lets keep the public nudity laws in effect in New York. Can you imagine a subway ride with clothing optional people at rush hour ? OMG the horror. Sometimes the greater good must be protected, over the rights of the individual. My case in point, during the early porn VHS-DVD popularity, little stores popped up everywhere selling tapes. These stores would open next to schools, churches etc, it did not matter, till a law was passed that they could not operate within a certain distance from a school or similar structure.Yes the owner displayed their tapes in the windows as promotional aides

To the OP, there are times in the outdoors when temporary brief nudity will happen. When nature calls and the nearest toilet is miles away, one finds a tree or bush. Swimming, rafting in the outdoors, i have been on trips where we brought suits and had to change when we got there. . The guys did a quick dash behind a tree, turned our backs and changed. Much to the jolles and puns of the other guests. The ladies were a little more reluctant to change in the bushes, so we / 2-3 guys held blankets in a sort of rectangle around them , while they changed. 3 guys turned around and the BF of the lady got to hold his corner and face her.. Same as after rafting and you need to change back to street clothes, if there ae no changing rooms, you improvise a quick change of some nice person holds a towel . blanket for you

Flasher is with the express intent that a non-consenting bystander *will* see.
Public nudity is that someone *might* see.
The OP's sitiuation is neither; she doesn't want anyone to see, and takes measures to reduce or eliminate the chances.
 
I wonder if the word 'public' might refer to people rather than place.

Being naked anywhere other people can congregate or see you could be considered 'public' nudity, even if it's an 'enclosed' area (e.g. a store).

A changing room, locker-room or restroom are referred to as 'public' but would be considered 'private'. Once you leave that area it's public.

But in terms of the 'Public Nudity' thread, I'd consider intentional nudity (except changing/adjusting clothing) outside of the subject's home to be eligible.

But different people have different views, which is why most picture threads here get a lot of nit-picky comments.
 
Just my two cents... I would define public nudity is being without clothes which especially expose the genitals in a location where you might be seen by the general public. This eliminates back yards and other personal property and closed sets. This would include any secluded areas such as parks, woods, etc where, even though a person might now not be in full view, there is still a chance of being seen.

As we taught in media law, pornography in written or visual media, with intent to arouse. It does NOT require handling of genitals. See Playboy.

But that’s not the question.

I concur. Public is a combination of whom and where.
