i seriously don't get it. so, there's everything that's happened with my mom this year.

now...i'm only on two days. why? because i can only work days with my schedule this semester, yah? that was the reason why i was transferred in the first place! my boss tells me he can only fit me in for 2 days a week, 3 if i wanna work the front on fridays. i ask why would i have to work the front? because "we'd have two people in photo" well, as the fuckin head of department brah, don't i deserve for be in photo?

so, i was all "i was transferred here because i needed days, and i was guaranteed them" my boss responds with "no, you were transferred to have a full time schedule" which is still fuckin bullshit! i was all "but you haven't given me a full time schedule since i've been here either!"

so, some time this week, i'm gonna confront my old boss, because someone fuckin lied to me yah? and it's bullshit. i called the corporate number, and there was only one attempt for call me, yah? and that attempt was on a day i specifically said i'd be in class! i ask him for call back, yah? he agreed. he never call back! i called the corporate number again, and gave him until that wednesday (i called on a sunday). i said if i didn't get word from my DM that i would go to the board of labor and hire an attorney. well, he never called me back. and, in the interim, i had been calling his office, trying for get hold of him, yah? still nothing. only reason why i haven't gone to the BoL yet was because of the holidays and all. and now i'm gonna go to the national news about how they grossly mistreat college students.

so, there's that, yah? then there's today. as the alleged head photo specialist, i have to oreder supplies, yah? i ordered paper (well, had a manager to, since he never gave me a fuckin sign on like he said he was when i first started). what does my boss do? he fuckin cuts my order from 12 to 3! we ran out saturday night, so i got to work today with a note from the tech saturday night sayin we were out of paper. so, i made calls, yah?

i ended up having to literally go all over broward county. i was kinda mad, but whatever. as the alleged head of the department, it's my responsibility, yah? so, the round trip ended up taking almost 3 hours. i get back, and the manager on duty (second in command at my store) was pissed at me. i told him exactly where i had to go and everything, so it's not like i fucked around. i have peoples able for verify where i was, yah? but he was about to write me up! it's like, no matter what i do, it's wrong.

oh yah, and he said i wasn't allowed for go on break since i was out most of the day. i was still on the clock brah. i worked my 8 hours today, yah? that's against the law, asshole!


so, my plans for the week are for start my new semester, call the board of labor, call the family friend who used for be the asst. state attorney, and call the media. i'm not gonna be silenced because this company is fucking with me. and, sometime in the next 2 weeks, i have to go see my old boss and confront him (not in a threatening manor, but definitely in an assertive one) about what the hell happened. who lied to me? was i really promoted? i know it says head photo specialist on my name tag, but i'm not coded as one in the system. i don't have access to all the reports i need, yah?

so, do i have a good plan?

Before you get the media involved with this, file your complaint with the Board of Labor. Call your friend who is a State Attorney and do not confront your prior Manager until you are scheduled to have your hearing with the Board of Labor otherwise you could complicate the matter further.

yah, because getting a job is so easy right now haha

i'm a college boy bruddah. since i'm finally making waves, i've decided, since i'm going into the medical field, that i could get a job at a hospital as transport or food services like my friend and ex co-worker willie did when he was in school for become an x-ray tech


and mahalo for the advice, nudeyorker. that's why i made this topic, so i wouldn't do anything stupid

Phil...no offense... but where did you go to Law School? The Board of Labor report will help if Surferboy loses his job. Without the complaint against his employer to the Board of Labor he has no chance of receiving unemployment benefits and it will put his employer on record. There actually is a law against his boss being an incompetent asshole if he is violating labor laws.

except that, by law, i'm owed the sick day i used when i brought in a dr's note. and by law, i should never have been bumped down to part-time without any paperwork being done.

I dont think Phil was being personal. He just likes to make strong points about issues thats all. He usually comes from a more cynical viewpoint. But I never see him be deliberately personal.

You should never mention lawyer or the DOL to your employer. EVER. Do not ever, ever, ever, do that again in your entire life for any reason. If you go to the DOL or you do hire a lawyer, then always let the lawyer or the DOL do the talking and do not ever tell your employer that you have contacted the DOL or hired a lawyer. Let the DOL or the lawyer contact your employer first and then be the model, the perfect, the best employee possible for the rest of your time at that job.

You have just been labeled, "a problem employee," and will find that your employer will now do everything in their power to legally fire you. That means they will do things like order 3 reams of paper instead of 12 and then blame you for it. They will look for every minute you're late, find any and every fault with your performance, and may even go so far as to sabotage your employment so they have reason to fire you.

From now on, get everything in writing and be sure to save copies at home of every single thing written thing they give you. Document incidents like this photo problem immediately being sure to name names, give times, and accounting for every action you make. Go over your time cards, your paychecks, and everything else. Make certain your behavior on the job is perfect. In the mean time, get prepared to find another job where you won't need your current one for a reference.

I can't speak to the legal issues as well as nudeyorker can (as he's a lawyer), but I can tell you what the corporate view of your action is and right now your name is sitting in some corporate lawyer's IN box waiting to see if they can fire you without getting into trouble. If they can't, they will go out of their way to make your life there miserable in hopes you will quit.

Good luck Nixxy, I hope things work out favorably for you. At least this job isn't all that important in your career path. Consider it a learning experience.

there's no reason for them for find a way for "legally fire me" since florida is an at-will employment state. meaning they don't necessarily need a reason for fire me.

also, when i had for stay home with my doctor's note back in february, i made damn sure i made a copy before i turned it in to my manager. i honestly never trusted him when the first thing he said to me was "you need to change school schedule. it's an inconvenience to me"

I'm glad I don't have to work while in college. I wouldn't have time anyway, my days are as full as can be.

It doesn't matter if Florida is, "at will," or not. You can still sue them for wrongful termination or discrimination and win. They can say you're not being fired for cause or discrimination but that doesn't mean that you actually were or that you can't make a case that you're a victim in court.

Yeah, Florida is an "at will" state meaning that you're employed at the pleasure of the boss. He can knock you down to part-time or fire you. But if he fires you without cause then you can get unemployment. Maybe he's fucking with you to get you to quit. If you quit there's no unemployment without a big stink.

Sorry about working for an asshole. I think everyone has had one at one time or another.

Well the laws differ from State to State, but MOST states do not offer unemployment benefits to part time workers. I got the impression that he is working part time.
After 8 years of republican rule, its a lot more employer friendly agency these days.


Most States will not repsond to complaints that a variable hour situation is not as predictable as a worker prefers. Companies have total discretion in setting up the hours for part time workers... As long as they do not exceed overtime constraints in any given day or week.
An employer accommodating YOUR schedule is not your right... its a favor they are doing you.

And, seriously, there is nothing they can do about an incompetent boss.
If its not an issue of overtime, harassment or dangerous working conditions... they really can't do much.

Except maybe make some phone calls and make your employer even MORE likely to fuck with you in revenge.

Sorry, maybe I am fulla shit... but in a world of jobs evaporating, and plenty of people willing to take whatever job you think you can't stand, employers do not have to put up with a lot of crap.
And they won't.

I can't tell you how many times I have seen a company fire a guy they didn't want there despite his doing his job well. They have to do it carefully... but they can do it in a way that gives you no cause of action... they do it daily. Hell there are BOOKS on the subject of how to safely fire people.

If a company isn't paying you your full wage, will not redress harassment, or some other overt crime... sure go to the Labor Relations guys.

But in general... you are not gonna get ahead much by lodging complaints against your employer... they will only make you suffer more for it, or fire you.


My advice is to buck up and pay your dues... buddy up with the boss and make him look good.

Whatever you might think your job is is irrelevant. your job is ALWAYS to make the person above you look like god to the person above them.
When you make YOUR immediate superior look good, your immediate superior takes care of you.
If he doesn't, quit and find a job working for someone who understands this.

Even as a self employed guy... the clients that come to me are working for other companies or clients whom they have to impress.
My job is to make them look good because they chose my company as a vendor.

Clooney makes 20 million bucks a picture because some OTHER guy is making 80 million.

HE did not start at that pay rate... he earned it by proving his value to his employers.

As a guy who has hired a lot of people over the years, I can tell you that what I see most often from young workers is a LOT of feelings of entitlement and a dearth of willingness to put out effort.
I have had young guys tell me they could work harder if I paid them more...

And entirely unable to understand my reply that they should try proving to me they could work harder and THEN I would pay them more.


If you are a young guy fresh to the labor force... you are not entitled to shit.
The onus is upon you to prove why you should even HAVE any given job.

And, seriously... in 30 years of working... of being hired and fired, of hiring and firing, I have NEVER seen one single Labor Board complaint over a part time worker.

And as for a doctor's note, either you're legally disabled or you're not. If you're on short-term disability then your employer has certain legal obligations. If you're not on short-term (or long-term) disability then your employer doesn't have to honor a damn thing. This isn't school. Doctors notes don't mean a damn thing.
