And as for a doctor's note, either you're legally disabled or you're not. If you're on short-term disability then your employer has certain legal obligations. If you're not on short-term (or long-term) disability then your employer doesn't have to honor a damn thing. This isn't school. Doctors notes don't mean a damn thing.

you missed the topic in which i explained the dr note. last february, i fucked up a muscle in my neck, yah? my doc gave me valium for it, but said he didn't want me working until i knew how it affected me, so he wrote me a dr's note for the day. at the time, i was still full time and had sick days. my old boss didn't pay me for it.

and yes, i'm part-time right now, but i shouldn't be. my mom is in management, and you can't push someone down to part-time without paperwork being filed.


And, seriously... in 30 years of working... of being hired and fired, of hiring and firing, I have NEVER seen one single Labor Board complaint over a part time worker.

except that i shouldn't be labeled as part-time. let's say that my old boss didn't transfer me over for day shifts like he had told me, and told my new boss i needed more hours period for full-time work, yah? well, i was never given that. which is why i wanna confront my old boss and see what the hell happened.

i understand you guys are tryin for teach me life lessons, but there's no reason for be a fuckin cock about it. i'm not gonna name names, but seriously, wtf?

EDIT: i can also prove favoritism in my store. my boss had said that the corporate level had "cut his budget hours" so everyone had a loss of some hours, yah? except for the latinos. one girl's hours increased from 24 to 32 hours a week. another was actually given over-time; he gave her 47 hours for the week. and, since the company's policy is for keep schedules for 3 years, i can easily prove it.

If Florida is a "at will" work state, why are you saying they can't legally move you from full time to part time? Dude, High School days are over. Nobody owes you anything.

Nobody wants an employer who has a weekly excuse (I hurt my neck, I need to leave early for school, I have a dentist appointment, I was up studying for that big test, my car broke down, etc).

For every employed person, there are 5 unemployed who would be "THRILLED" to have a full or part time job.

with your attitude, who do you expect will be a positive reference when you go for the "better" job? saying your last boss was an ass isn't a reason for leaving that job.

BTW, unless Florida is different, there is no legal differentiation between full and part time work. Ditto goes for the federal Fair Labor Standards Act (FLSA).

Look into it. That a company has a policy requiring paperwork does not mean there is a law mandating this.


Because of the laws... management is pressured to have MORE workers on part time, rather then fewer workers full time. It gets them out of lots of legal requirements.

Sucks, but it's how the system works.

All I am saying is that, unless your services are critical to the operation... its not a good time to be making demands on employers.

The most important lesson is this; unless you can show evidence of an actual violation of law... the labor board is not gonna help you...

Prove what? Who ever told you life was fair? What makes you think there is a law that your Boss must allocate hours evenly?

There is no law against favoritism. I promise you that my favorite workers are the ones that get raises and promotions.
They are my favorites because they PERFORM.
What you call Favoritism may no different than Recognition of Merit.

Your Boss can do pretty much as he pleases with part time workers.

As a boss I have full discretion to assess my workers' skills and dedication and reward them as I see fit.
I can tell you that if I have a college kid who wants more hours, and a hard working young woman with a baby at home to care for, I am gonna give the hours to the person who is supporting a child.


What I am trying to convey here is that you have no idea what your boss is thinking or why he makes the choices he makes...

He may actually NOT be acting like a dick.... he may have good reasons you are unaware of...


What I am saying is that if you want a better situation at this job, or ANY job, you DON'T whine and complain and threaten over it....
You try and make yourself an ASSET your boss wants to keep.

i honestly never trusted him when the first thing he said to me was "you need to change school schedule. it's an inconvenience to me"
I worked in the grocery business for years and found that the managers who gave me the most difficult times with school schedules were the ones who were total zeros who would never go the distance to get a degree. They resented that I was doing it while working 5 days per week.

Ultimately, I got out of retail and got a job as a waiter. Days free to go to school, worked the 5 - 11 dinner shift, and made decent money.

right. because i've called out every weel. oh wait...i didn't. before you go off and be a douche bag, maybe you should know the story, yah? i had an injury a year ago, and my mom had a heart attack in november. save for those two incidents, the only other time i've been away from work was on my vacation. unless, of course, that also counts as a "weekly excuse"

speedo - what attitude? calling someone i didn't like an ass? that's hardly a tude. while i hated the guy, i still treated him with respect - something he doesn't give to his workers.

i create a topic in hopes for some fuckin advice, but get bitter people coming down on me. that's awesome.

Surferboy, there's loads of good advice in this thread. Maybe just not what u wanted to hear. Just take all the hassle & crap u deal with there as part of the job. Or quit.

welcome to the NEW world my friend! Used to be...workers had certain rights or "expectations" of actually being appreciated as an employee. Those days are LONG GONE! I've had MANY FRIENDS fired, ,"layed off", dismissed, or otherwise removed for whatever reason with NO COMPENSATION...regardless if they had an "illness" or "issue" (civil service might STILL be the exception but for how long?)

The worker has no right to ANY expectations anymore...they should be, in the words of your greedy employer, "JUST BE HAPPY TO HAVE A JOB!"

Well, with Obama and the dire need to re-build US employment, we may see some change in that regard, Garth.

Truth be told, tho... non-union workers have never had any 'right' to be appreciated.

There are lots of shitty bosses out there who do not appreciate any employee, and another bunch who might not appreciate a given employee...

And the employee's power has always been the right to tell the boss to stuff the job up his ass.

Bosses who suck and can not keep effective staff do not perform well, and they get shit-canned by THEIR bosses, or the businesses fail to thrive.

Any company has always had the power to layoff any employee for financial reasons ( layoffs)


In today's world every employee needs to think of themselves as being free lance contractors. IT is up to them to manage their career and pay attention to their skills and the evolution of the market for their skills.


Surfer... I don't mean to sound harsh... but life is simply not fair. You get what you can earn.
Don't make trouble at work because it will just result in an even more hostile working environment.

And start to think strategically about your working life.
Befriend or otherwise support the people who have power over not only your job, but the nature and quality of that job.

I know this all sound really base and manipulative... but you need to get used to the idea that working in this world is not a happy happy joy joy land of comfort and security...

Its a bunch of people competing with each other for advantage.

The successful people are the ones who figure that out and sharpen their teeth.

You should never mention lawyer or the DOL to your employer. EVER.

This is so true. Not only for legal reasons but your boss will make your life hell from that point on. He will do anything in his power to make you quit, therefore relieving himself of any wrongful dismissal case

But if you proceed you have a bigger battle to fight then you can imagine so GOOD LUCK

A doctor's note doesn't mean anything for sick days. It has no legal standing what-so-ever. Your employer doesn't give a damn about your doctor. They care that you missed a day of work. You can ask your boss about pay for that day if company policy says you are entitled to that pay. You should check with Human Resources to make sure that's the case before politely asking your boss.

The fact that everyone is basically telling you the same thing should give you an inkling that we're right.

Nobody is trying to be a douchebag. We are working to impress upon you the need to understand how the real working world operates so that you spend much less time learning that we're right. You are gaining the benefit of years of experience before you have learned it yourself.

If you don't like hearing what we're saying then you seriously need to re-evaluate your career path. Jobs at all levels come with swallowing your pride, swallowing some shit, and pretending you like it.

The only time you may be protected from some change of responsibilities and hours is if you have an employment contract with your employer. You may also be protected under collective bargaining agreements. Otherwise you're screwed.

You will likely be fired or forced out of this job soon. The fact that they've cut you to part-time should be a signal to you that they do not consider you to be a valuable employee. Now that you've created an issue, they want you out even more. I highly suggest spending a great deal of time looking for a position elsewhere while you still have a job. This is an unpleasant fact, not an attempt to be a douchebag. You can either be indignant or learn from this mistake and make your next job all about doing your job, some of your boss's job, some of your coworkers' jobs, and brown nosing your boss so that he or she looks good. That's really all that working for someone else is about no matter what job you have anywhere.

If you don't like it then work for yourself but be advised that you will be kissing far more ass when you work for yourself. If you're not your own toughest, meanest, nastiest boss you've ever had, then you likely won't do well working for yourself.
