Awful example. Locker Rooms are enclosed private spaces on private property with their own rules. It's illegal for even the property/business owners to install cameras in such locations.
If you are in a public place you don't need consent. You should have no expectation of privacy when in public. And a Nude Beach in no different.

How is the locker room the same as being in public for the world to SEE? I dont understand your logic in the matter! A locker is a private place the nude beach is a very public beach where anyone can see you

As far as I know, taking pictures or filming on nude beaches is also prohibited, without the consent of those who are there.
We don't know the context behind this photo and I'm not saying anything against Nick, just clarifying that there are rules at nudist beaches.
PS: I really think that the person in the picture is Nick and not someone else, and he can take as many naked pictures as he wants, that I won't object to it.

2. The guy doesn't have much facial hair, maybe stubble but mostly (if not all) and blur and light

The hair (which looks dry) is not far removed from Nick, shoulder and neck are very similar too. The differences can be easily explained by the blur/movement.

My take is that due to the blur, you'll never be able to tell for sure. However, there is a good chance it is Nick, there are strong similarities.
