Your reaction was normal, I think. And don't worry Nixxy they won't get a new car out of it. If they do then Florida law is screwed up. I suffered whiplash and back injury as a result of being rearended and I waiting on a court date. I have damage at C-3, C-5, C-6, T-3,T-7 and T-8. The girl that hit me, her insurance co. has refused to pay anything even though the girl admitted to the officer that she knew her brakes were not working. It's even in the police report. It's been almost 4 years and nothing has happened yet. Just waiting for that court date.

*Nixxy News Update: Car accident*
Thos fuckers claimed the woman is injured. I fuckin knew it! Yet, they didn't call the cops when the accident happened. We just called All State and they said the other people made a claim that the woman is injured. I knew they were gonna do this because she joked about it. We oringinally called our insurance company (All State, they use Proegressive) because we suspected insurance fraud. There's no scratches on our car. The airbags never deployed. We were slowing down to a stop at a stop light. I hit them maybe goin at 5 mph. Anyways, we suspected fraud. So now the woman is claiming to be injured. Which, as I've said, I knew she was gonna try to pull because she made a joke about it at the scene.
Yet, they never called the police. They told me that they thought their car was a piece of shit, and that now that they've settled into their new place down here, they wanted a new car. So, we think they're gonna make a fraudulent claim to get a new car. However, we're having All State come down the look at our car and how there's not even a scratch on it. I'll keep you guys posted on what happens.

I'm sorry to hear that Pappy. Mommy has a bad spine too. Years of gymnastics weakened her discs, then like, right after Leo was born, she had gone to Publix (a super makret, for those that don't know) and some fuckin jackass didn't stop at a stop sign and almost hit mom as she walked across the street with her cart to put the groceries in her car. She avoided him, but the dude hit the cart, which came back at her, causing her to twist the wrong way. And now she has some herniated discs. And get this, the dude lived right behind us, the next street over, and his wife was a manager at Publix. And his fuckin insurance was fuckin gimp, and didn't even fully cover her medical bills. Thank Nixxy. I hope everything turns out well for you with your accident. The girl that hit me told the officer that she was only doing 15-20 mph, and the officer said "Yeah, right". Totaled my car, hit me so hard that it buckeled the roof of my car as well as breaking the seat back of the driver's seat (I was flat on my back when the dust settled). My lawyer seems to think there might be some money in it for me so I'm just biding my time.

My solution is that you should have someone you know (but she doesn't know you know) follow her around with a camera, particularly those cell phones which also function as digital cameras. Or hire someone. If a person isn't disabled, they'll slip up and use their "injured" hand or take off their cast or go somewhere without a wheelchair.
Trust me, a PI is cheaper than your insurance hikes will be.

My son was rearended by a big truck going about 80 miles an hour. It forced his vehicle into rearending the car in front of him. The other car and my son's vehicle were both stopped. Well, two weeks before the statue of limitations was up, the woman driver that was in front of my son sued us. She has gotten all she can from the guy that caused the wreck. Now she is after us. Funny thing, her husband also filed suit for a "wreck" the same day. Understand she has done this many times. But none of that information can be brought forth in court.
So, I know how you feel about someone trying to screw you. Here you were concerned and what did you get? Screwed. But don't let it change who you are. That woman doesn't have character. You do. Don't let her rob you of yours.
As my agent told me, don't worry about it. That is why you have insurance. We'll handle it is what he told me. So I, after several days of stewing and fuming, finally decided my agent was right.

About 4 years ago as I was leaving work one evening, just at dusk driving my brand new 2 month old Mustang. Four lane divided street. A car makes a sudden and high speed left turn in front me, I broadside the car, a real T-Bone. Skid marks, air bags, flying glass, flat tires etc. A real hum-dinger. I hit her (the police said) at about 40 mph (below the speed limit). I have never been so shaken up in my life! Totalled my car, her car and made a real mess in the street. She was cited with 5, count 'em 5, tickets. Drunk driving, no insurance, no registration, no license and assaulting a police officer when she tried to smack him for not making me apologize to her! The next day I had a nasty bruise diagonaly across my chest from the seat belt and one side of my face looked like I had been burned from the air bag....but I was ok and she wasn't hurt at all and refused medical care. If she had been sober it would have been different.
5 tickets and guess who got sued for a million dollars. Yep, me. Last I knew my insurance company had tied up the case so bad the guy who called me the last time said, "oh don't worry about this, we have a building full of lawyers who will make sure her children's grandchildren's grandchildren won't see a dime."

Yes, you can sue anyone for anything. There is a catch if you do and lose, you get to pay for all the court costs etc. And you can be countersued.
Most competent judges will through out frivilous law suits and fine the attornyes for bringing an obviously rediculous claim to court.
For instance, if I had an attorney file a suit against you for hitting me in the face, I would need an attorney. Now once, the judge finds out that we have never met face to face, that attorney can be fined and in some states I can be fined. Also, you could sue me for slander. Your chances of winning would be almost guaranteed. HOw much money you wuold be awarded depends on a lot of factors depending on how much money I have to start with.
In Arkansas, a jury would determine the damages.
What keeps all of us from being sued all the time is that the loser pays for everything.
In your case, if the woman loses it is her insurance company that pays the bill.
In Arkansas, there are lawyers that do nothing but represent people like the lady who had the accident. They get a percentage. So it is mass production deal. If after a while the "volunteer" attorneys see that they aren't going to make any money out of the deal, they bail out.
When my son had that wreck we received at least 20 or more letters from attorneys offering to represent us in a lawsuit witch of course them getting a big piece of the action if we win.
Usually, insurance companies just pay these kinds of lawyers and people off. They make a deal. That is what those kind of people are after and the lawyers again get part of the action.

When I first went up to them and asked them if they were ok, and after that bitch made the joke that her neck was hurintg, she told me, and I quote, "Oh, don't worry, this car is a piece of shit anyways, now that we've moved here and settled down, we were gonna get a new car."

Hmm...Justice Phoenix...I like the sound of that. I think I'd be the only fair judge out there who doesn't give in to others' bribery and special interest groups.
EDIT: Another thing that raised a red flag was that they didn't wanna call the cops. First thing they do, besides that fuckin evil joke, was call their insurance company. I offered to give my info first, but no. Insurance company first.
